Pfizer's Power: Big Pharma Must Never Again Hold Public Health Hostage. By Daniel O’Conner
The pandemic exposed a profound moral hazard: corporations gained extraordinary leverage over governments while transparency, accountability, and the public interest took a back seat.
Another pandemic must not become another bonanza for pharmaceutical corporations empowered by public fear and government desperation. COVID-19 exposed something deeply troubling: when the world needed lifesaving innovation, powerful pharmaceutical companies gained extraordinary negotiating leverage over sovereign governments. The consequences should outrage anyone who believes public health belongs to the people.
In 2021, Public Citizen's landmark investigation, Pfizer's Power, documented vaccine contracts containing sweeping indemnification provisions, confidentiality restrictions, controls over redistribution, and sovereign-immunity waivers.
TrialSite News covered these arrangements. Subsequent disclosures in South Africa reinforced concerns about one-sided negotiations.
This was more than aggressive commerce. It exposed a dangerous moral hazard: private corporations leveraging a global emergency to secure protections ordinary citizens could scarcely imagine.
Then came Europe's Pfizer controversy. European Commission President Ursula von der Leyen exchanged text messages with Pfizer CEO Albert Bourla during critical vaccine negotiations. When The New York Times sought those communications, the Commission refused disclosure. In May 2025, Europe's General Court annulled that refusal, finding the Commission's explanations inadequate. The ruling did not establish corruption. But why should multibillion-euro public procurement decisions be surrounded by such secrecy?
TrialSite also early in the pandemic reported on AdventHealth's ICAM COVID-19 treatment protocol and allegations that pharmaceutical research relationships might compromise clinical independence. Although the available contractual evidence does not establish Pfizer suppressed ICAM, the episode raises a fundamental question: Should any pharmaceutical sponsor possess the power to influence treatment decisions beyond its own clinical trials?
Absolutely not.
The majority of the scientific and medical establishment believes that Pfizer and BioNTech as well as Moderna delivered an important scientific achievement. TrialSite News tracked the performance of these products, finding durability and reactogenicity-driven challenges. The mass scale of the operation led to at least tens of thousands of patients chronically injured. To date there is no support although finally during the second year of the Trump-Kennedy administration Health and Human Services is announcing intentions for a clinic and other supports. But what will happen after the midterms?
Certainly, innovation deserves recognition and fair compensation. But commercial success must never translate into political supremacy. Especially in a global public health crisis with no liability to patients!
Pharmaceutical companies answer to shareholders. Governments answer to citizens. Physicians answer to patients.
When those obligations collide, the public interest must prevail. Every single time.
If there ever is another pandemic we must demand transparent procurement contracts, meaningful liability accountability, independent clinical judgment, and uncompromising scrutiny of industry influence. No secret arrangements. No extraordinary corporate privileges without public justification. No surrender of sovereign responsibility under the banner of emergency preparedness.
We need pharmaceutical innovation, but we must reject pharmaceutical (or any corporate) domination.
A public health crisis is not a corporate opportunity to rewrite the rules of accountability. Human lives are not bargaining chips. Sovereignty is not for sale.
Never again should fear give Big Pharma the upper hand over the public it is supposed to serve.
